Hong Kong trademark registration protects brand identity through the Intellectual Property Department (IPD) under the Trade Marks Ordinance (Cap. 559). The process grants exclusive rights for 10 years, renewable indefinitely, preventing unauthorized use and enhancing market value.

Eligibility Requirements

Marks must be distinctive, non-descriptive, and not conflict with existing registrations; generic terms like “Delicious Food” for a restaurant fail this test. Applicants declare genuine use or intent to use in Hong Kong, though evidence isn’t required upfront—non-use for three years post-registration risks revocation.

Foreign applicants need a local service address (no P.O. boxes) or agent; multiple classes are allowed.

Registration Steps

Start with a preliminary search on the IPD Online Search System to check availability and conflicts.​

Submit Form T2 online via e-filing (preferred), by post, or in person, including mark image, applicant details, goods/services per Nice Classification, and fees: HK$2,000 for one class, HK$1,000 per additional class.

IPD conducts a deficiency check, then substantive examination (2-4 months) for compliance; respond to objections within six months.

Examination to Registration

Approved marks publish in the Hong Kong Intellectual Property Journal for a three-month opposition window; defend or amend if challenged.

Unopposed marks register within 12-16 months total, issuing a certificate effective from filing date.

Renewal and Maintenance

Renew every 10 years using Form T8 within six months before expiry (HK$2,670 per class), or six months after with late fees; grace periods prevent automatic lapse.
