Trademark Renewal in China

A registered trademark in China is valid for 10 years. The owner should file the renewal within 12 months before expiry. If this deadline is missed, there is still a 6-month grace period, but additional official fees will apply. Once renewed, the trademark remains valid for another 10 years.  

For foreign applicants without a business domicile in China, renewal is generally handled through a qualified Chinese trademark agency. For Madrid registrations designating China, renewal is handled through WIPO, not through the regular domestic renewal procedure.  

Typical documents include the renewal application form, the applicant’s identity or company registration documents, a Chinese translation if the documents are in a foreign language, and a Power of Attorney if an agent is appointed.   

Practical tip: do not wait until the last minute. Track the expiry date early and prepare the renewal documents in advance.
